ODA Coordination and Management

ODA coordination and management in the ARMM is guided by national and regional laws and issuances such as the following:

  1. RA 9054 which provides for the following:
    1. Section 10, Article XII. –Creation of REDPB. The Regional Economic and Development Planning Board (REDPB) serves as the planning, coordinating and monitoring agency for all development plans, programs and projects intended for ARMM of ARMM.
    2. Section 13, Article III – Equitable Share in National Budget. The National Government shall provide the autonomous region an equitable share in the annual national budget and foreign assisted projects to accelerate it development.
    3. Section 11, Article X – Economic Agreement. The Regional Government shall evolve a system of economic agreement and trade compacts to generate block grant for regional investment and of the regional economic structures.
    4. Sec. 8, Art. IX –Sources of the Regional Government. Sources of the revenue of the Regional Government shall include block grants derived from economic agreements or conventions entered into or authorized by the Regional Assembly, donations endowments, foreign assistance, and other forms of aid.
    5. Sec. 12. Art. IX- Donations or Grants. The Regional Government may accept donations or grants for the development and welfare of the people of autonomous region. Such donations or grants that are used exclusively to finance project for education, health, youth and culture, and economic development may b deducted in full from the taxable income of the donor grantor.
    6. Section14 Article IX, - Foreign or Domestic Loans.  The Regional Governor may be authorized by the Regional Assembly to contract foreign or domestic loans in accordance with the provisions of the Constitution.
    7. Section 34, Article XII. Foreign Investment. The Regional Government shall regulate and exercise authority over investments within its jurisdiction.
  2. Executive Order 125/ 125-A s. 2002 - Further Enhancing the Devolution of Powers and Functions, Programs and Projects of National Government Agencies to ARMM, including the devolution of ODA funded programs and projects in the autonomous region.
  3. Executive Order 125 Implementing Rules and Regulations (DBM Circular 2003–1) - “The Regional Planning and Development Office (RPDO) of the ARMM shall manage and administer all matters that pertain to ODA and locally funded programs and projects of the ARMM.”
  4. Muslim Mindanao Autonomy Act No. 287 ((Administrative Code of the ARMM). Section 3 provides that the Regional Planning and Development Office shall be the technical arm of the Regional Economic and Development Planning Board (REDPB).  In addition, it shall exercise powers and functions through its line services, as follows:   (1) The Policy, Planning, Programming and Development Services,  (2) The ODA Services. The ODA Services shall : a) Formulate and undertake approved strategies to access ODA programs and projects; b.    Establish and maintain a  database of existing and pipeline ODA-accessed projects; c.   Monitor the status and progress of implementation of the ODA-accessed projects based on the terms and conditions in the agreements; d.  Recommend appropriate action to resolve or mitigate problems, if any, in the implementation of programs and projects based on the terms and conditions in the agreements and/or agreed plans as the case maybe, in coordination with concerned regional and national government agencies and other project implementers and stakeholders; e.  Submit regular reports on the accessed Development Assistance to the Office of the Regional Governor; and f.   Perform such other functions as may be provided by law.
  5. ARMM E.O. No. 7 s. 2005 and E.O. No. 7 s. 2008  – The RPDO takes lead in all ODA-related activities in ARMM and chairs the Oversight Committee on Strengthening Development Assistance Coordination in ARMM. Coordinates the review, evaluation and recommendation of project proposals intended for ODA funding for consideration of Regional Governor as Chairman of the Board. Consistent with this, a MOA between the ARG and the UNICEF, a Regional Project Coordination and Monitoring Unit (RPCMU) lodged at the RPDO was been established.
  6. Memorandum Order No. 02A (Relocation of Office). The ODA Office will be transferred to the RPDO Building.

ODA Entry Points

Depending on the nature of the ODA project, national, regional and local government arrangements as well as donor agency’s policies, rules and procedures, there are at least seven (7) ODA implementation mechanism and arrangements for the  management of ODA programs in the region.

  1. ODA grants projects to the ARG – ODA implements the program through its Project Management Offices e.g BEAM-AusAid, 6th CP-UNFPA
  2. ODA grants through Minda – Mindanao Development Agency coordinates and monitors the implementation of the projects eg. Act for Peace-UNDP
  3. ODA grants through consultancy – ODA grants projects to the ARG but implemented through the consultants hired by the concerned donors. E.g JICA
  4. ODA grants or loans directly negotiated by the ARG – The ARG negotiates the project grant or the loan and RLAs implements the same once approved. E.g CPC 6, ILO
  5. ODA grants through or directly negotiated by the NGOs – There are projects that are directly negotiated and implemented by NGOs. E.g BDA, CFSI, NDI, OXFAM
  6. ODA projects through the loan of the national government. Eg. MRDP-WB, Per EO 581, the ARG implements the ASFP project negotiated by the National Government with the World Bank through a loan.
  7. ODA Loan or grant projects directly negotiated by or extended to the LGUs. LGUs directly implement the project. e.g. Mindanao Basic Urban Services Sector funded by the ADB.
