FIRST REGULAR SESSION

Begun and held in Cotabato City, the twenty third day of April, Nineteen Hundred and Ninety.

(REGIONAL ACT NO. 04)

SECTION  1. Declaration Policy.  -  The Regional Planning and Development Board is an agency of the Regional Government which shall identify, evaluate, and recommend the annual work programs and comprehensive development plans of the Autonomous Region to the Regional Assembly . As may be necessary , in accordance with  regional needs , it shall be activated and strengthened to meet its goals and promoting social and economic development  of the Autonomous Region in Muslim Mindanao.

SECTION  2.  Additional Members. -  In order to make the composition of the Regional Planning and Development Board more responsive and effective, it is hereby provided to include as additional members, the Regional Governor, five (five) more members of the Regional Assembly to be designated by the Speaker and one representative each from the Professional, Youth and Religious sectors.

The Regional Governor shall act as the Ex- Officio Chairman of the Regional Planning and Development Board, preside over its meetings and performs such other duties and functions as may be necessary in the  conduct of the Board affairs.

The vice chairman shall be selected  by the majority members of the Regional Planning and Development Board from among themselves , to act as chairman in the absence  of the Ex- Officio chairman and to perform such other duties as may be assigned to him by the Board.

The chairman , upon the recommendation  of the majority of the members of the Board, shall appoint the representatives from the private sectors to the Board , who must be residents of the Autonomous Region in Muslim Mindanao for at least  five (5) years . 

SECTION 3.  Additional Powers. - The Board, apart from its powers and functions under the Organic Act, is also vested with the authority to call upon any representative of the private sector, local and national public agencies for such views or advice as may be pertinent to any matter under its consideration.

SECTION 4.  Board Meeting. -  The Board shall meet at least once every quarter, at such time , place and date as may be determined and fixed by the Board, provided that there shall be, in all its meeting , prior notices served to all the members thereof. Special meetings may be called by the Ex-Officio chairman or at the request of the majority of the members of the Board , provided that notices specifying the agenda to be taken be served at  least three (3) days before the special meeting.

 A majority of the members of the Board shall constitute a quorum to do business.  In no case proxy be allowed in any meeting f the Board be it regular or special.

SECTION 5.  Technical Staff.  -  In the discharge of its duties and functions, the Board shall be assisted by a technical office as its secretariat, which shall be called as the Regional Planning and Development Office, to be headed by the Executive Director to ensure the technical capability and competence of the Board.

SECTION 6.  Powers, Functions and Responsibilities.  – As the technical arm of the Board, the Regional Planning and Development Office shall have the following powers, functions and responsibilities.

 

a.
Evaluate and review proposed programs and projects for consideration by the Regional Planning and Development Board;

 

b.
Monitor and assess the programs of project implementation in the Autonomous Region in Muslim Mindanao;

 

c.
Serve as the technical staff of the Regional Planning and Development Board in the Autonomous Region in Muslim Mindanao;

 

d.
Provide technical assistance to implementing agencies in the Autonomous Region in identifying and developing regional programs and projects;

 

e.
Coordinate with the regional office of other departments and agencies, and assists the local government units in the region in the performance of their assigned tasks, and;

 

f.
Perform such other appropriate tasks as may be assigned by the Regional Planning and Development Board and other competent authorities.

SECTION 7.  Organizational Structural.  -  The Regional Planning and Development Office shall be headed by an Executive Director with the following divisions:

Economic Planning Division
Social Planning Division
Infrastructure Planning Division
Financial and Administrative Support Division

SECTION 8. Office of the Executive Director. -  The Office of the Director shall be composed of the Executive Director, Assistant Executive Director and Secretary.

The Office of the Executive Director shall have the following functions:

 
a.
Advice and assist the Regional Planning and Development Board in the formulation and implementation of policies, plans, programs and projects;
 
b.
Office;
 
c.
Coordinate all national and foreign assisted projects, and;
 
d.
Perform such other duties and responsibilities  as may be assigned by Board to promote efficiency and effectiveness in the delivery of public Services or as may be assigned by law.

SECTION 9.  Macro- Economic Planning Division. -  The Macro- Economic Planning Division shall have the following functions and responsibilities:

 
a.
Coordinate for the Regional Planning and Development Board  all integrated and comprehensive planning,  programming and  regional budget preparation activities:
 
b.
Coordinate researches and  statistical  activities  as required  for planning, policy formulation and project development;
 
c.
Assess development  performances and extend technical assistance to local government  units,  development  authorities  and  sectoral  agencies  in  the Autonomous Region;
 
d.
Coordinate  the preparation  of socio- economic profile,  annual medium  and   long term plans, climatic maps and at lasses for the region;
 
e.
Coordinate all National and Foreign assisted projects;
 
f.
Perform such other functions as may be directed by the Executive Director and other competent authority

SECTION 10. Economic Planning Division. -  The Economic Planning Division shall have the following functions and responsibilities:

 
a.
Coordinate the formulation and assessment of the economic sector development plan, programs, policies, guidelines and priorities for the consideration of the RPDB;
 
b.
Evaluate and monitor proposed and on–going agricultural and industrial programs and projects in the region;
 
c.
Provide and technical assistance on matters relating to economic developments;
 
d.
Coordinate economic planning, investment and programming, budgeting, project development, preparation of progress and performance reports for the consideration of the RPDB;
 
e.
Perform other necessary functions as may be directed by the Executive Director and other competent authority.

SECTION 11. Social Planning Division.-  The Social Planning Division shall have the following functions and responsibilities;

 
a.
Coordinate the formulation and assessment of social development plans, programs, policies, guidelines and priorities for the consideration of the RPDB;
 
b.
Evaluate and monitor proposed and on–going social development programs and projects in the Autonomous Region;
 
c.
Provide technical assistance to social development concerns of regional agencies and local government;
 
 
d.

Assist the RPDB in the preparation of progress and performance reports    on the social development sector, and;

 
e.
Perform other related functions as may be assigned by the Executive Director and other competent authority.

SECTION 12Infrastructure Planning Division.- The Infrastructure Planning Division shall have the following functions and responsibilities:

 
a.
Coordinate  the formulation and assessment of infrastructure development   plans,  programs, policies  guidelines and priorities for the consideration of the RPDB;
 
b.
Evaluate and monitor proposed and on-going infrastructure development programs and projects in the Autonomous Region;
 
c.
Provide technical assistance on matters relating to infrastructure development for the region;
 
d.
Assist the RPDB infrastructure investment programming, budgeting and other development ,and;
 
e.
Perform other related functions as may be assigned by the Executive Director and other competent authority.

SECTION 13Financial and Administrative Support Division. -The Division shall have the following functions and responsibilities:

 

a.
Provide support services relating to personnel, staff development, records, management, supplies and equipment, budgeting and accounting, collection and general clerical and utility services; and

 

b.
Perform other related function as may be assigned by the Executive Director and other competent authority.

SECTION 14. Appropriations. - An initial amount of THREE HUNDRED THOUSAND PESOS (P 300,000.00) is hereby appropriated to be included in the General Appropriations Act of 1991. Thereafter, such sums as may be necessary for its continued implementation shall be included in the General Appropriations Act.

SECTION 15. Separability. -   If for any cause any part of this Regional Act is declared unconstitutional for contrary to the provisions of R. A. 6734, the rest of the provisions shall remain in force and effect.
